भारत की आकस्मिक निधि (Contingency Fund of India)

भारत की आकस्मिक निधि (Contingency Fund of India) एक विशेष निधि (Special Fund) है, जिसका उद्देश्य ऐसी अप्रत्याशित एवं तात्कालिक परिस्थितियों (Unforeseen and Urgent Expenditure) में वित्तीय सहायता उपलब्ध कराना है, जहाँ तत्काल व्यय आवश्यक हो तथा संसद (Parliament) से पूर्व स्वीकृति प्राप्त करना संभव न हो।

भारत के संविधान (Constitution of India) के अनुच्छेद 267(1) [Article 267(1)] के अंतर्गत इस निधि की स्थापना की गई है। सामान्यतः भारत सरकार (Government of India) का प्रत्येक व्यय भारत की संचित निधि (Consolidated Fund of India) से संसद की स्वीकृति (Parliamentary Approval) के पश्चात किया जाता है, किन्तु आकस्मिक एवं अनपेक्षित परिस्थितियों में इस निधि का उपयोग अग्रिम (Advance) के रूप में किया जाता है।

वर्तमान में यह निधि भारत के राष्ट्रपति (President of India) के नियंत्रण में रहती है तथा इसके संचालन हेतु भारत सरकार द्वारा निर्धारित नियम लागू होते हैं।

संवैधानिक आधार (Constitutional Basis)

भारत के संविधान के अनुच्छेद 267(1) के अनुसार संसद को यह अधिकार प्राप्त है कि वह कानून द्वारा भारत की आकस्मिक निधि स्थापित करे। इसी प्रावधान के अंतर्गत Contingency Fund of India Act, 1950 बनाया गया।

यह निधि राष्ट्रपति (President of India) के अधीन रहती है तथा वित्त मंत्रालय (Ministry of Finance) इसके प्रशासन का कार्य करता है।

आकस्मिक निधि की आवश्यकता (Need for Contingency Fund)

सामान्य वित्तीय प्रक्रिया में—

  • संसद द्वारा अनुदान (Grant) स्वीकृत किया जाता है।

  • विनियोग अधिनियम (Appropriation Act) पारित होता है।

  • तत्पश्चात व्यय की अनुमति मिलती है।

किन्तु कुछ परिस्थितियाँ ऐसी होती हैं जहाँ—

  • व्यय अत्यन्त तात्कालिक हो,

  • बजट प्रावधान उपलब्ध न हो,

  • संसद का सत्र (Session) न चल रहा हो,

  • अथवा स्वीकृति प्राप्त करने में विलम्ब से सार्वजनिक हित प्रभावित हो सकता हो।

ऐसी स्थिति में आकस्मिक निधि से अग्रिम (Advance) प्रदान किया जाता है।

निधि का स्वरूप (Nature of the Fund)

आकस्मिक निधि से किया गया भुगतान अंतिम व्यय (Final Expenditure) नहीं माना जाता।

यह केवल एक अस्थायी अग्रिम (Temporary Advance) होता है, जिसे बाद में संसद की स्वीकृति प्राप्त होने पर भारत की संचित निधि (Consolidated Fund of India) से पुनः भर दिया जाता है।

अतः यह निधि एक प्रकार की "Imprest Fund" के रूप में कार्य करती है।

निधि से व्यय की स्वीकृति (Sanction of Expenditure)

जब किसी मंत्रालय/विभाग को आकस्मिक व्यय की आवश्यकता होती है तो वह वित्त मंत्रालय (Ministry of Finance) के माध्यम से प्रस्ताव प्रस्तुत करता है।

स्वीकृति के पश्चात—

  1. आकस्मिक निधि से राशि अग्रिम रूप में जारी की जाती है।

  2. बाद में संसद में अनुपूरक अनुदान (Supplementary Grant) प्रस्तुत किया जाता है।

  3. संसद द्वारा स्वीकृति मिलने पर विनियोग अधिनियम (Appropriation Act) पारित किया जाता है।

  4. तत्पश्चात संचित निधि (Consolidated Fund of India) से राशि निकालकर आकस्मिक निधि में पुनर्भरण (Recoupment) कर दिया जाता है।

रेलवे के संदर्भ में (Position in Indian Railways)

ऐतिहासिक रूप से रेलवे वित्त (Railway Finance) के पृथक बजट (Separate Railway Budget) के समय वित्त आयुक्त (रेलवे)  की महत्वपूर्ण भूमिका थी।

किन्तु वर्ष 2017 से रेलवे बजट (Railway Budget) के सामान्य बजट (General Budget) में विलय के पश्चात—

The Contingency Fund of India is a special fund established under Article 267(1) of the Constitution of India to meet unforeseen and urgent expenditures pending authorization by Parliament.

Normally, all Government expenditure is met from the Consolidated Fund of India after Parliamentary approval through the Appropriation Act. However, when urgent expenditure becomes necessary and there is no immediate budget provision or Parliamentary approval, advances are drawn from the Contingency Fund.

The Fund is placed at the disposal of the President of India and is administered in accordance with statutory and financial rules of the Government of India.

The Contingency Fund of India derives its authority from Article 267(1) of the Constitution of India and is governed by the Contingency Fund of India Act, 1950.

After the merger of the Railway Budget with the General Budget in 2017, Railway finances are governed under the general framework of Government finance. Therefore, the Contingency Fund is controlled by the President and operated through the Ministry of Finance, not independently by Railways.

Thus, the statement in older notes that “Financial Commissioner (Railways) controls the fund” does not reflect the present position.
